Be Cautious with Digital Signatures Using Odoo
In fact, it's quite convenient: Just send the customer a link in which they can view the offer and then confirm it digitally right away. Does that mean the contract is truly sealed?
To be honest, we wouldn't rely on it:
The requirements for a legally valid digital signature are stringent, certainly more so than simply placing a generic signature-like mark on the document to be sent, which is neither an original nor personally handwritten.
While personal handwriting isn't necessary, there are other requirements. To utilize this feature, it should be 100% legally secure.
Based on our current knowledge, this is not the case with the standard Odoo setup that underlies this signature function.
.
What is Required in this Process?
Any potential data manipulation must be detectable. (For both contracting parties)
The signature must be unequivocally associated with a specific person.
And in case of doubt, this person must be able to prove that the signature originates from them and was created under the necessary security measures.
The ITIS AG is currently working with ITISeasy.business to integrate the digital signature in a way that complies with the requirements of the German Electronic Signature Act (SigG) and the European legal framework eIDAS. This ensures that it can be used for all contracts where no specific formal requirements are legally mandated.
